Youโre not ๐ด๐ถ๐ฑ๐ฑ๐ฐ๐ด๐ฆ๐ฅ to take the ๐๐น๐ฬ๐ต๐๐ฒ๐ถ๐ป mug. But for many itโs quietly become part of the ritual.

German ๐๐ฆ๐ช๐ฉ๐ฏ๐ข๐ค๐ฉ๐ต๐ด๐ฎ๐ขฬ๐ณ๐ฌ๐ต๐ฆ are in full swing and if you order a mulled wine, itโll come in a proper mug or glass. You pay ๐๐ง๐ข๐ฏ๐ฅ, ๐ข deposit which you get back if you return it.
Exceptโฆlots of people donโt.
Legally, youโre required to return it; youโve bought the mulled wine, not the mug.
But up to 50% of mugs are estimated not to make it back.
Stallholders expect this and since the police have bigger priorities, youโre very unlikely to be arrested.
Most people who take their cup are following what they ๐ต๐ฉ๐ช๐ฏ๐ฌ the rule is or should be: the ๐ณ๐ฆ๐ข๐ญ rule, not the law.
Which is why itโs not just souvenir-seeking tourists, itโs locals as well.
Because youโve paid ๐ด๐ฐ๐ฎ๐ฆ๐ต๐ฉ๐ช๐ฏ๐จ, it doesnโt feel like stealing. That โฌ3-โฌ5 Pfand becomes the permission slip.
Now thereโs no obvious slippery slope here; youโre unlikely to start stealing other things. Just a socially sanctioned fudge, thatโs got some interesting Compliance lessons:ย
ย ๐ง ๐๐ฐ๐ฎ๐ฎ๐ฐ๐ฏ ๐ฌ๐ฏ๐ฐ๐ธ๐ญ๐ฆ๐ฅ๐จ๐ฆ ๐ค๐ข๐ฏ ๐ฃ๐ฆ ๐ธ๐ณ๐ฐ๐ฏ๐จ: people presume itโs allowed, when actually it isnโt.
๐ฅ ๐๐ฐ๐ค๐ช๐ข๐ญ ๐ฏ๐ฐ๐ณ๐ฎ๐ด ๐ธ๐ช๐ญ๐ญ ๐ฐ๐ง๐ต๐ฆ๐ฏ ๐ต๐ณ๐ถ๐ฎ๐ฑ ๐ง๐ฐ๐ณ๐ฎ๐ข๐ญ ๐ณ๐ถ๐ญ๐ฆ๐ด: rationalising that โ๐ฆ๐ท๐ฆ๐ณ๐บ๐ฐ๐ฏ๐ฆ ๐ฅ๐ฐ๐ฆ๐ด ๐ช๐ตโ, even if they donโt.
I paid the deposit, so Iโve obviously bought itโ
And probably most importantly:
๐ ๐๐ถ๐ญ๐ฆ๐ด ๐ข๐ณ๐ฆ๐ฏโ๐ต ๐ข๐ญ๐ธ๐ข๐บ๐ด ๐ณ๐ช๐จ๐ฉ๐ต: when a law prevents people from doing โreasonableโ things, itโs usually the law thatโs wrong, not the people. And if we canโt scrap the law, maybe quietly tolerating breaches is the next best thing.
Youโll find the similar dynamics in organisations, minus the mulled wine.
Ever kept your mug? Full disclosure: I may have one or two at home. For research purposes, obviously.
