Youโ€™re not ๐˜ด๐˜ถ๐˜ฑ๐˜ฑ๐˜ฐ๐˜ด๐˜ฆ๐˜ฅ to take the ๐—š๐—น๐˜‚ฬˆ๐—ต๐˜„๐—ฒ๐—ถ๐—ป mug. But for many itโ€™s quietly become part of the ritual.

German ๐˜ž๐˜ฆ๐˜ช๐˜ฉ๐˜ฏ๐˜ข๐˜ค๐˜ฉ๐˜ต๐˜ด๐˜ฎ๐˜ขฬˆ๐˜ณ๐˜ฌ๐˜ต๐˜ฆ are in full swing and if you order a mulled wine, itโ€™ll come in a proper mug or glass. You pay ๐˜—๐˜ง๐˜ข๐˜ฏ๐˜ฅ, ๐˜ข deposit which you get back if you return it.

Exceptโ€ฆlots of people donโ€™t.

Legally, youโ€™re required to return it; youโ€™ve bought the mulled wine, not the mug.

But up to 50% of mugs are estimated not to make it back.

Stallholders expect this and since the police have bigger priorities, youโ€™re very unlikely to be arrested.

Most people who take their cup are following what they ๐˜ต๐˜ฉ๐˜ช๐˜ฏ๐˜ฌ the rule is or should be: the ๐˜ณ๐˜ฆ๐˜ข๐˜ญ rule, not the law.

Which is why itโ€™s not just souvenir-seeking tourists, itโ€™s locals as well.

Because youโ€™ve paid ๐˜ด๐˜ฐ๐˜ฎ๐˜ฆ๐˜ต๐˜ฉ๐˜ช๐˜ฏ๐˜จ, it doesnโ€™t feel like stealing. That โ‚ฌ3-โ‚ฌ5 Pfand becomes the permission slip.

Now thereโ€™s no obvious slippery slope here; youโ€™re unlikely to start stealing other things. Just a socially sanctioned fudge, thatโ€™s got some interesting Compliance lessons:ย

And probably most importantly:

๐Ÿ˜‰ ๐˜™๐˜ถ๐˜ญ๐˜ฆ๐˜ด ๐˜ข๐˜ณ๐˜ฆ๐˜ฏโ€™๐˜ต ๐˜ข๐˜ญ๐˜ธ๐˜ข๐˜บ๐˜ด ๐˜ณ๐˜ช๐˜จ๐˜ฉ๐˜ต: when a law prevents people from doing โ€˜reasonableโ€™ things, itโ€™s usually the law thatโ€™s wrong, not the people. And if we canโ€™t scrap the law, maybe quietly tolerating breaches is the next best thing.

Youโ€™ll find the similar dynamics in organisations, minus the mulled wine.

Ever kept your mug? Full disclosure: I may have one or two at home. For research purposes, obviously.
